Types of LPA’s
There are two types of LPA’s which are for financial decisions and health care decisions.
An LPA for financial decisions can be used to allow someone to make decisions for you even while you still have mental capacity. These decisions may include such things as buying and selling property, investing money and paying bills.
An LPA for health is different in that it only comes into effect if you have lost the capacity to make decisions for yourself. These decisions may include where you live, your medical care, what you eat and what kind of activities you should take part in.
Why is an LPA important?
We live in a world of uncertainty and unfortunately any of us could be unexpectedly affected by an accident or sudden illness. Having an LPA in place gives you peace of mind of knowing that your financial affairs and medical decisions are managed by those that you trust when you are unable to make such decisions yourself.
If you do not have an LPA in place and you lose mental capacity or the ability to make decisions, it is too late. Your family may have to make an application to the Court of Protection to be able to handle your affairs. Making an application to the Court of Protection is a very complicated and expensive procedure and there is no guarantee that the decision made by the Court is in accordance with your wishes. Having an LPA in place means that your loved ones can make the appropriate decisions on your behalf and are better suited to make such decisions compared to the Court of Protection since they know you personally.
Do I need an LPA if I have a Will?
Even if you have made a Will you should still consider an LPA. Your Will takes care of your affairs after your death but is not useable during your life. If you are unable to manage your affairs during your lifetime, only an LPA can be used by your loved ones to make decisions on your behalf
